Why You Can’t Buy Kinder Surprise Eggs in the US – And How to Get Them Shipped

Many people grew up with Kinder Surprise – a simple, yet brilliant product consisting of a chocolate egg housing a surprise toy inside that was invented back in 1974.

If you live in the US, however, you simply can’t put your hands on this exhilarating little item because of a regulatory ban. When and Why Was Kinder Surprise Banned in the US

The ban is the result of the 1938 Federal Food, Drug, and Cosmetic Act. As per this regulatory framework, “non-nutritive” objects can’t be embedded in food.

Kinder Surprise consists of a plastic toy-holding capsule that is completely encased by the chocolate shell. The regulation suggests that such a design poses a significant choking hazard.
